These Terms and Conditions (“Terms”) govern your access to and use of pakodigy.com (the “Site”) and the translation, interpretation, and linguistic consulting services (the “Services”) provided by PAKODIGY LLC (“Pakodigy”, “we”, “us”, “our”). By using the Site or engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or the Services.
1. Our Services
Pakodigy provides Arabic and other language translation, localization, interpretation, and linguistic consulting services to legal, medical, business, and government clients. The specific scope, deliverables, timeline, and fees for each engagement are set out in a quote, order, or signed Service Agreement, which forms part of these Terms for that engagement.
2. Quotes, Orders & Payment
Quotes are estimates based on the information and source material you provide and may be revised if the scope, volume, or complexity of the work changes. Payment terms (including deposits, milestone payments, or payment in full) are specified at the time of booking. Work generally begins once payment or an agreed deposit has been received. Late or failed payments may result in a pause or delay of ongoing work.
3. Client Responsibilities
You are responsible for providing accurate, legible, and complete source materials, and for clearly describing the intended use, audience, and any certification or formatting requirements for your project. Delays or errors caused by incomplete, unclear, or late-supplied materials are not the responsibility of Pakodigy and may affect delivery timelines or pricing.
4. Revisions & Quality
We aim to deliver accurate, high-quality translations that meet the standard agreed in your Service Agreement. If you believe a delivered translation contains a genuine accuracy, terminology, or certification error, contact us within 14 days of delivery with specific details, and we will revise it at no additional cost. Requests based on stylistic preference, or changes to the source document after work has begun, may be treated as new, chargeable work. See our Refund Policy for further detail.
5. Confidentiality
We treat documents and information you share with us as confidential and use them only to provide the requested Services. We do not sell or disclose your materials to third parties except where necessary to deliver the Services (for example, to a vetted linguist or notarization partner bound by confidentiality obligations), or where required by law.
6. Intellectual Property
You retain ownership of the source materials you provide. Upon full payment, you receive full rights to use the final translated deliverables for their intended purpose. Pakodigy retains ownership of the Site, its content, design, and branding, which may not be copied, reproduced, or used without our prior written consent.
7. Limitation of Liability
While we take care to deliver accurate and professional translations, Pakodigy is not liable for indirect, incidental, or consequential damages arising from use of our Services, including decisions made based on translated content. Our total liability for any claim relating to a specific engagement is limited to the amount paid for that engagement.
8. Third-Party Services
Certain add-on services, such as notarization, apostille, or courier delivery, are fulfilled by third-party providers. Pakodigy is not responsible for delays, errors, or costs arising from these third parties once your materials have been dispatched to them.
9. Website Use
You agree to use the Site only for lawful purposes and not to interfere with its operation, security, or availability. We may update, suspend, or discontinue any part of the Site at any time without notice.
10. Governing Law
These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law principles, and any disputes arising from these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in New Mexico.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Services or legal requirements. The “Last updated” date above reflects the most recent revision. Continued use of the Site or Services after changes are posted constitutes acceptance of the updated Terms.
